ABSTRACT

The Future of Asylum Seekers and Refugees.’ It is an area that has increasingly dominated media images and parliamentary and legal debates in Australia and globally. In Australia, there are growing voices of denunciation in relation to the Federal Government’s harsh policies regarding the mandatory detention of ‘unlawful non-citizens’ (McMaster, 2001; Jupp, 2002; Mares, 2001), especially in relation to children and unaccompanied minors. It seems ironic and contradictory that Australia ratified the Convention on the Rights of the Child (CROC) and implemented the notion of the ‘best interests of the child’ in almost all legal domains except those pertaining to asylum seeking children who do not possess a valid visa and are therefore ‘unlawful non-citizens’ (Mason, 1999, pp. 531, 532).
